Consent & Liability Waiver
A legal disclaimer
This Consent and Liability Waiver (“Waiver”) applies to anyone who proceeds with registration or participation and is effective between you (the “Participant”) and MBK Academy, including its affiliates, partners, employees, volunteers, and associated organizations, including but not limited to Al-Ansaar Islamic Foundation (collectively referred to as "MBK Academy and Affiliates").
By checking the confirmation box, the Participant acknowledges that they have read and understood the full Waiver on this page, and agree to be bound by its following terms and conditions:
1. Consent to Participate
I, the undersigned Participant, voluntarily consent to participate in swimming training and related activities provided by MBK Academy. I acknowledge that I have read and understood the Academy’s policies and agree to abide by them.
2. Acknowledgment of Risk
I acknowledge that swimming and water-related activities involve inherent risks, including but not limited to:

Slips, trips, or falls in or around the pool area

Near-drowning incidents

Injuries resulting from physical activity, including muscle strains, sprains, or other bodily harm

Exposure to waterborne illnesses or chlorine-related skin or eye irritations
I understand and accept these risks, and I confirm that I am physically capable of participating in swimming activities.
3. Release of Liability
To the fullest extent permitted under Alberta law, I, on behalf of myself and my heirs, executors, and assigns, do hereby release, waive, discharge, and hold harmless MBK Academy and its Affiliates, including Al-Ansaar Islamic Foundation, its directors, officers, instructors, employees, agents, volunteers, and representatives, from any and all claims, liabilities, demands, actions, causes of action, damages, or losses, including but not limited to personal injury, death, or property damage, that may arise out of or in connection with my participation in MBK Academy’s programs and activities.
4. Medical Authorization & Emergency Care
In the event of an emergency where I am unable to communicate or provide consent, I authorize MBK Academy to seek appropriate medical attention on my behalf. I understand that any medical costs incurred will be my sole responsibility.
5. Code of Conduct
I agree to follow all rules, regulations, and safety instructions set forth by MBK Academy and its Affiliates. MBK Academy reserves the right to remove any participant from the program without refund if they exhibit unsafe, disruptive, or inappropriate behavior.
6. Governing Law
This Waiver shall be governed by and interpreted in accordance with the laws of the Province of Alberta and the applicable federal laws of Canada. Any disputes arising from this agreement shall be resolved in the courts of Alberta.
7. Acknowledgement & Agreement
I have carefully read, and fully understand this Waiver and its terms, and voluntarily agree to its terms, intending to be legally bound.
8. Parent/Guardian Consent (for Participants Under 18)
If the Participant is under eighteen (18) years of age, this consent must be completed by a parent or legal guardian. I, the undersigned, am the parent or legal guardian of the minor named above (“Participant”), and I have authority to act on their behalf. I have read and understood this Waiver (including especially sections 2–4 regarding risks and medical authorization) and agree to its terms and conditions on behalf of the Participant. I confirm that the Participant is physically fit and capable of participating in swimming training and related activities provided by MBK Academy, and I consent to their participation under the terms of this Waiver.
9. Emergency Protocol Disclaimer
In the event of an emergency—such as the arrival of paramedics or firefighters—participants must ensure they are appropriately covered. MBK Academy emphasizes that it is each participant’s personal responsibility to maintain modest dress at all times, including during unexpected situations.
MBK Academy is not liable for any breach of modesty during emergencies, as participants are expected to come prepared and remain dressed modestly throughout the program.
Participants are also highly encouraged to keep their towels or bathrobe on the pool deck at all times as they enter and exit the pool.
